    This is a warning to every physician who speaks up, treats patients, and refuses to stay silent.

    A federal judge acquitted Dr. Ron Elfenbein. The AMA defended his billing. A coding expert found his charts appropriate. The government’s own expert contradicted the indictment.

    Still, the government appealed.

    Now, Dr. Elfenbein faces a second federal criminal trial—and up to 50 years in prison—over roughly $250 in disputed billing across five patient charts.

    IMA is urging the DOJ to review Dr. Elfenbein’s case and to pursue a just resolution.

    It certainly is bigger than one doctor. This is obvious and blatant retribution for some ‘sin’ the doctor committed which has nothing to do with billing errors.

    What idiots set such ridiculous punishments for minor billing errors? Is there no compassion in government?

    The fact that this is still an ongoing case over a $250 billing code is ludricrous, especially in light of the billions of $$ in fraud in Medicaid, Medicare, and other federal programs recently identified. Is this a holdover from the Biden Administration’s rabid philosophy of going after those physicians who did not practice the “sedate & ventilate” Covid-19 protocol? The lives that were ruined by that administration (Fauci, et al) was historic.
